DRAPER ā An obstruction charge filed against a Draper mother in a child abuse investigation has been permanently dismissed.
Bianca Feldkircher, 32, was charged Friday in 3rd District Court with obstruction of justice, a third-degree felony. But by the end of the day, prosecutors filed a motion to have the charge dismissed “in the interests of justice and for the reasons that it was incorrectly filed.”
The charge was dismissed with prejudice, meaning it cannot be refiled.
The incorrect filing came four months after Feldkircher’s husband was charged with abusing his infant twins.
In November, Eric Johann Feldkircher, 37, was charged with two counts of aggravated child abuse, a second-degree felony. He was supposed to be caring for his 7-week-old twins but in September, “was seen on video dropping them, shaking them, swinging them by their feet, hitting their heads on objects and being overall aggressive with them,” according to charging documents.
A doctor “reported that both babies had torn bridging veins, retinal hemorrhaging, and possible spinal injuries. Both babies will suffer with seizures throughout their lives and will possibly have cerebral palsy,” the charges allege. The doctor told police the twins would have issues “seeing, walking and eating.”
Bianca filed for divorce in January, according to court records.
Court documents don’t indicate how the Salt Lake County District Attorney’s Office incorrectly filed the charges Friday.
